Expert Witness FAQ - Dr. Harriet Jacobster, AuDWhat are Dr. Harriet Jacobster's qualifications as an expert witness?
I am an ASHA-certified audiologist with over 40 years of experience in advanced diagnostics and treatment of hearing loss and tinnitus. I hold a Doctor of Audiology degree and specialized certifications in tinnitus diagnosis and treatment, cognition, and military noise exposure. I am licensed in both New York and Florida and have been qualified as an expert in multiple state and federal cases.
What types of cases do you handle?
I serve as an expert witness in cases involving military and occupational noise exposure, VA disability benefits, personal injury, medical malpractice, and product liability. My recent work includes 3M Combat Arms Earplug litigation, motor vehicle accident–related tinnitus, and malpractice cases involving hearing loss.
Do you have experience with military and veteran cases?
Yes. I am VA-trained in Compensation & Pension evaluations and have testified in multiple military hearing loss and tinnitus cases. I also provide Nexus letters and independent evaluations for Veterans seeking disability benefits and appeals.
Have you worked on large product liability cases?
Yes. I have provided expert witness services in multiple cases against 3M involving defective Combat Arms Earplugs (2012–2015 versions). My role included record review, report preparation, and testimony on the effects of noise exposure and hearing protection failure.
What services do you provide to attorneys?
I provide comprehensive case support including medical record review, causation analysis, expert reports, rebuttal reports, and courtroom testimony. I also prepare Nexus letters for VA-related cases and assist in identifying methodological flaws or inconsistencies in opposing expert reports. My role is to deliver clear, scientifically grounded expertise that strengthens case strategy and holds up under Daubert/FRE 702 review.
Have you been accepted as an expert in court?
Yes. I have been retained by both plaintiff and defense counsel and have been qualified to provide testimony in malpractice, personal injury, wrongful death, and product liability cases across multiple jurisdictions.
What is your background in tinnitus evaluation?
I hold advanced certificates in Tinnitus Retraining Therapy and hyperacusis management from the Jastreboff Tinnitus & Hyperacusis Center. I have authored and presented extensively on tinnitus for professional associations, and I provide expert evaluation of tinnitus causation in both clinical and litigation settings.
How do you approach a Daubert or FRE 702 challenge?
My reports are grounded in peer-reviewed science, current audiological standards, and AMA Guides methodology. I carefully document calibration, masking, reliability, and consistency issues in opposing reports and ensure that my testimony withstands methodological scrutiny. This structured, evidence-based approach positions me strongly against Daubert and FRE 702 challenges.
What makes you different from other audiology experts?
I combine 40 years of audiology practice with holistic health credentials as a Certified Health Coach, Master Trainer, and Functional Aging Specialist. This gives me a unique ability to address not only the physiological aspects of hearing loss and tinnitus but also cognitive, occupational, and quality-of-life impacts — factors often critical in litigation.
Do you accept both plaintiff and defense cases?
Yes. I work with both plaintiff and defense attorneys nationwide. My role is to provide impartial, scientifically sound audiology expertise that can withstand cross-examination.
Where are you located, and do you work nationally?
My primary office is in New Windsor, New York, and I am licensed in both New York and Florida. I accept cases nationwide and am available for remote consultations, virtual testimony, and on-site evaluations when required.
How do attorneys retain your services?
Attorneys may contact me directly via my website or phone. I typically request case background materials for preliminary review, after which we establish a formal retention agreement and timeline. Clear communication about deadlines and expectations ensures smooth collaboration.
What are your fee structures?
Fees are billed hourly for record review, report writing, and testimony, with standard retainers required in advance. Flat-rate packages are available for Nexus letters and limited case reviews. A detailed fee schedule is provided upon request to counsel.
Do you also provide academic or professional publications?
Yes. I have authored articles on tinnitus for the American Tinnitus Association, served as a peer reviewer for audiology journals, and presented at national and state conventions. My upcoming book, ‘Tinnitus: A Whole-Person Approach to Management,’ further demonstrates my depth of expertise.
How quickly can you provide an expert report?
Turnaround depends on case complexity, but most reports can be completed within 2–4 weeks after receipt of full records. Expedited services are available when deadlines require it.
